These terms cover your use of howorthfrancis.com. They're short because the site is simple: read it, use the assistant if it helps, get in touch if you want to work together. Coaching, training, and keynote engagements are governed by a separate written agreement.
By using the website at howorthfrancis.com (the "Site"), operated by Howorth Francis Associates, LLC ("HFA," "we," "us"), you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Site. You must be 18 or older to use the site assistant or book a conversation.
The writing, frameworks, images, video, and design on the Site belong to HFA or are used with permission. You're welcome to read, share links to, and quote short passages from our articles with attribution and a link back. Please don't republish whole articles, use our materials in paid training or products, or present them as your own without written permission.
Process-Oriented Leadership™ and CHOICE™ are trademarks of HFA. The Five Dysfunctions of a Team model and the Online Team Assessment belong to The Table Group; other names and research we cite belong to their owners.
The Site includes an automated assistant to help you think through whether our work fits your situation. It is software, not a person, and it can be wrong. It doesn't give professional, clinical, legal, or financial advice, and it can't make commitments on HFA's behalf — any pricing, scope, or availability it mentions is indicative until confirmed by Charlotte or Rod in writing. How we handle what you type is set out in the Privacy Policy.
Reading the Site, using the assistant, emailing us, or booking an introductory conversation does not make you a client of HFA. A client relationship begins only when you and HFA sign a written agreement. HFA's services are coaching, training, and speaking — not therapy or any other clinical service. See the Disclaimer.
Fees, schedules, cancellation, confidentiality, and everything else about paid work are set out in your engagement agreement. If anything on the Site conflicts with that agreement, the agreement wins. Introductory conversations are booked through Calendly and are subject to its terms as well as ours.
Please don't use the Site or the assistant to break the law; send spam, malware, or abusive content; try to access systems or data you're not authorized to; scrape or copy the Site in bulk; or attempt to make the assistant produce harmful or misleading output. We may block access if you do.
We link to research, publishers, and services we think are useful. We don't control those sites and aren't responsible for their content or practices.
We work to keep the Site accurate and available, but it is provided "as is" and "as available." To the extent the law allows, HFA makes no warranties, express or implied, about the Site or the assistant, including that they will be error-free, uninterrupted, or fit for a particular purpose.
To the extent the law allows, HFA, Charlotte Howorth, and Rod Francis are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Site or the assistant. Our total liability for any claim relating to the Site is limited to one hundred US dollars. This section does not apply to paid engagements, which are governed by your agreement, and does not limit liability that cannot be limited by law.
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in New York County, New York, and you and HFA consent to their jurisdiction.
We may update these terms. The effective date at the top will change when we do, and continuing to use the Site afterwards means you accept the updated terms. If any part of these terms is found unenforceable, the rest still applies.
